Terms & Conditions
The agreement between you and 4couple

1. Introduction
These Terms & Conditions (the “Terms”) apply to the services that are accessible to you (the “Services”) through our mobile application (the “App”) and our website at 4couple.ai (the “Website”).
Each time you access the App or the Website you agree that you accept and will be bound by these Terms, as well as all other laws and regulations that apply to the Services. Please read them carefully before using any of the Services. They form a legal agreement between you and WUMI sp. z o.o., a company registered in Poland at ul. Prosta 20, 00-850 Warszawa (KRS 0001259684, NIP 5273231770) (“we”, “us”, “our”, “4couple”).
Our Privacy Policy sets out important information about how we collect, process and use your information, including sensitive information about your emotional state, mental health and relationship. Where the Services ask for your separate consent to process that information, your consent is given under the Privacy Policy and not under these Terms. Only continue to use the Services if you agree with these Terms and understand how we use the information you provide.
We may revise these Terms at any time and will notify you of the updated version. From time to time, updates to the App may be issued through your app store provider. Depending on the update, you may not be able to use the App until you have downloaded the latest version and accepted any new terms.
2. Accessing the Services
You must be at least 18 years old to use the Services. By using them you confirm that you are 18 or older and legally able to enter into a binding agreement with us. The Services are not directed to anyone under 18, and if you are under 18 you must not use or access them. We may ask you to confirm your age, and we will close any account we reasonably believe belongs to someone under 18.
You warrant that you are the owner of the device on which you download the App and access the Services, or that you have the device owner's permission to do so. You accept responsibility under these Terms for use of the App on any device. You also agree that we have no liability for access to your information by another person in the event that you share your device or otherwise make it accessible to someone else.
3. The Services
4couple is a relationship app for couples. Depending on your plan, the Services may include Translate My Emotions, the AI Companion (your own chat and a partners' chat), the Mood Checker and partner signals, the Film Chooser, the Date Planner, the Wheel of Fortune, the Wishlist, Important Days and reminders. The Services provide content in the form of prompts, suggestions, tips, insights and AI-generated conversations, some of which draw on established approaches to communication and emotional wellbeing.
The Website is part of the Services. It describes the App and lets you open a wishlist that someone has chosen to share with you by link.
We may change, amend, restrict or remove any content or feature that makes up the Services at any time, and we have no obligation to maintain any particular content or feature regardless of your or your partner's engagement with it.
4. Artificial intelligence features
Some features, including the AI Companion, Translate My Emotions, mood insights and AI suggestions, use artificial intelligence. When you use them you are interacting with an AI system, not a human. Your text, and any voice recording or photo you provide, is sent from the App to our server and to our AI and speech-to-text providers to generate the response you see, as described in the Privacy Policy.
AI can be helpful, but it can also produce responses that are inaccurate, incomplete, or not right for your situation. You should treat anything the Services suggest as a starting point, use your own judgment, and not rely on it as professional advice. You alone decide what to send to your partner and what to act on. We do not guarantee any particular result from using the AI features, and the Services have not been clinically validated.
The AI Companion uses automated classification to check messages for signs that you or someone else may be at risk and, where it detects a serious risk, shows crisis resources instead of an AI reply. This is an automated safety feature. No person at 4couple monitors or reviews your conversations, and the feature is not a substitute for contacting emergency services or a qualified professional.
The classifier is automated and imperfect. It may fail to detect a message that indicates risk, and it may show resources when there is no risk. Do not rely on it to get you help. Showing you resources is the only thing this feature does: we do not monitor conversations, and we do not contact emergency services, a helpline, your partner or anyone else on your behalf. The resources themselves come from third parties, as section 13 explains.
5. Not therapy, not medical care, not an emergency service
The Services, including the AI Companion and Translate My Emotions, are for general support, communication and reflection only. They are not a substitute for professional advice, therapy, counselling, or medical or mental-health care, and they do not diagnose or treat any condition. 4couple is not a healthcare provider, is not a medical device, and is not covered by HIPAA or equivalent healthcare regulation. You acknowledge that the Services cannot guarantee any particular outcome and should not be relied on alone to make decisions about your relationship or your health.
The Services are not for emergencies. If you or someone else is in danger, thinking about self-harm, or needs urgent help, contact your local emergency services or a qualified professional straight away. You are solely responsible for the accuracy of the information you enter and for how you use any insights you take from the Services or any information shared with you by a linked partner.
6. Your account and profile
You may need to create an account and set a password before you can use some of the Services. You are responsible for keeping your password and account confidential and for all activity that occurs under your account. Your account is personal to you, must be used only by you, and is not transferable. You must provide true, current and complete information when you register and keep it up to date, and you must notify us immediately if you suspect any unauthorised use of your account or password.
If you link accounts with a partner, you each keep your own account. Some information and content is shared between linked partners automatically, including your first name, birthday, the relationship facts you both confirm, your mood check-ins and notes, the signals you send, and everything either of you writes or adds in the partners' chat with the AI Companion. Your own chat with the AI Companion is private to you and is never visible to your partner. The Privacy Policy sets out exactly what your partner can and cannot see. By linking accounts you agree to this sharing, and you must not link accounts with someone who has not agreed to it.
A link ends in one of two ways: either of you unlinks in Settings, or one of you deletes their account. The effect is the same either way. Content the two of you made together — the partners' chat and its summaries, your shared watchlist and matches, and the insights about you both — is deleted for both of you and cannot be recovered. Content each of you made stays with whoever made it, but you stop being able to see each other's. Deleting an account does this and also erases everything belonging to the person who left. You may link again afterwards, with the same person or someone else, but nothing deleted when the previous link ended comes back. Section 13 of the Privacy Policy sets this out in full.
7. Fees and payment
Some Services are free and others require payment. Some Services may be free for a period and then require a payment, which may be taken automatically by your chosen payment method. We will always make the payment terms clear to you before you sign up for a paid Service, and those terms form part of these Terms.
- Couple subscription: one subscription covers both linked partners. The partner who purchases it is the subscriber and is responsible for payment. If the subscription is cancelled or expires, both partners lose access to the paid Services. If the link ends while the subscription is running — because either of you unlinks, or because the subscriber deletes their account — the partner who is not the subscriber loses access immediately; a subscriber who unlinks keeps the subscription they are paying for. Losing access this way does not entitle you to a refund.
- How you pay: you may purchase paid Services through the app store you downloaded the App from, or directly through our Website. If you buy through an app store, you are also subject to that store's terms. We never receive or store your card details; payments are handled by the app store or our payment provider.
- Price changes: we may change the price or nature of a paid Service. If you are already paying for that Service, we will give you notice before any price change takes effect.
- Automatic renewal: subscriptions renew automatically at the end of each subscription period unless you cancel before the renewal date. If you do not cancel in time, you will be charged for the next period.
- Cancellation: you can manage or cancel a subscription in your app store account settings or, where you purchased directly from us, from within the App or by contacting us. If you cancel, you will not receive a refund for the remaining part of the current subscription period.
- Refunds: if you bought a Service from an app store, refund requests are handled by that store and we are unable to process them. If you bought directly from us, contact us. Any statutory refund rights you have under Polish and EU consumer law, or under the consumer law of the place where you live, are not affected.
- Right to withdraw: as an EU consumer you may have a 14-day right to withdraw from a purchase. Where you ask us to begin a digital service immediately, that right may end once the service has started. Your statutory consumer rights are not affected by these Terms.
8. Promotional offers
We may make promotional offers from time to time, which may include discounts or account credits, may be subject to expiry dates, and may apply only to selected users. We may withhold or remove credit, or end a promotion without notice, if we reasonably believe a user is not acting in good faith in relation to the terms of the promotion.
9. Our ownership rights
The App, the Website and the Services contain logos, software, code, images, audio, video, text, icons, graphics, information and other content (together, “4couple Content”). All 4couple Content, and the way it is assembled and arranged, is owned by us or our licensors and is protected by copyright, trademark and other intellectual property laws.
We grant you a limited, personal, non-transferable, non-sublicensable and non-exclusive licence to use the App and the 4couple Content solely to receive the Services and in accordance with these Terms and any rules of the app store you downloaded the App from. This licence is revocable at any time.
Except to the extent permitted by law, you must not copy, modify, adapt, create a derivative work from, reverse-engineer, reverse-assemble or attempt to discover any source code in the App or any 4couple Content. You must not sell, rent, lease, loan, redistribute, sublicense, republish or otherwise transfer any right in the App or 4couple Content, and you must preserve all copyright and other notices. Nothing in these Terms grants you any licence to use our trademarks or those of any third party.
10. Your content
The messages, conversations, moods, notes, voice recordings, photos and other content you put into the Services belong to you (“Your Content”). To operate the Services, you grant us a licence to store and process Your Content, to generate responses, summaries, insights and memory from it, and to share it with the service providers who power our features (for example our hosting, AI and speech-to-text providers), only as needed to provide the Services to you and as described in our Privacy Policy. Outputs the AI generates from Your Content are provided to you as part of the Services and you may use them for your own personal purposes.
You are responsible for Your Content and for how you use anything the Services produce. Your Content will often include information about other people, including your partner, your children, and people you mention. You confirm that you have the right to share that information with us and, where it will be visible to your linked partner, with them. Do not upload photos of other people without their agreement.
Some features let you publish Your Content by link, such as a shared wishlist. Anyone holding that link can read what you have shared, and can pass the link on. You decide what to share and can stop sharing at any time in the App.
11. Acceptable use
You must not post to, or transmit using, the Services any material:
- that is threatening, defamatory, obscene, indecent, offensive, abusive, harassing, discriminatory, or that may incite hatred or cause distress to others;
- for which you have not obtained all necessary rights, licences or consents;
- that encourages conduct that would be a criminal offence, give rise to civil liability, or otherwise breach the law or the rights of any third party in any country;
- that is technically harmful, including viruses, malware, corrupted data or other harmful code; or
- that contains or solicits another person's personal data without their consent, or for any unlawful purpose.
You must also not:
- use the Services or any 4couple Content in any unlawful manner;
- misuse the Services, including by hacking, inserting malicious code, or attempting to manipulate the AI into producing harmful content;
- infringe our or any third party's intellectual property or other rights;
- use the Services to harass, abuse, control, coerce or harm another person, including your partner;
- link accounts with, or access the account of, a person who has not agreed to it;
- place an unreasonable load on our servers or infrastructure; or
- act in any way that may cause access to or use of the Services to be interrupted, damaged or impaired.
We may remove any material posted to or transmitted using the Services in breach of these Terms, or for any other reasonable cause.
12. Termination of the Services
We may suspend or terminate your access to the Services, and these Terms, if we reasonably believe you have breached them, are under 18, or have used the Services in a way that could harm other users or us. In those circumstances you are not entitled to a refund of any amount you have paid us. We may also modify or discontinue the Services, or any part of them, temporarily or permanently, and we will give notice of any significant change where we reasonably can.
You may stop using the Services and delete your account at any time in Settings. Deleting your account permanently deletes Your Content as described in the Privacy Policy. On termination of these Terms for any reason: all rights granted to you under them will end; you will no longer have access to the Services; and you must stop all activities they authorised. The provisions of these Terms that by their nature should continue (such as ownership, disclaimers and liability) will remain in effect.
13. Third-party services and links
The Services rely on some third-party services, and their terms also apply where relevant:
- App stores: the stores that distribute the App and process payments.
- Our technology providers: our hosting, AI, speech-to-text, analytics, notification, email and subscription providers, listed on our Sub-processors page.
Crisis resources shown in the App, such as helpline directories, are provided by third parties for your convenience. We do our best to keep them accurate but do not control them. Any other links to third-party content, apps or websites are provided for your convenience only; we do not control and are not responsible for them, and if you access them you do so at your own risk.
14. Indemnity
To the extent permitted by law, you agree to indemnify and hold us, our affiliates, and our and their officers, directors, agents and employees harmless from any losses, damages, costs and expenses (including reasonable legal fees) arising out of any claim brought by a third party due to or arising out of your breach of these Terms or applicable law, your misuse of the Services, Your Content, or your infringement of any intellectual property or other rights of a third party. This clause does not apply to the extent such losses result from our own breach or negligence, and it does not affect your mandatory rights as a consumer.
15. Disclaimers
The Services are provided “as is” and “as available”, without conditions, warranties or other terms of any kind other than those required by law and which cannot be excluded. To the maximum extent permitted by law, we exclude all representations, warranties, conditions and other terms that might otherwise apply to the Services, including any warranty that the Services will improve your relationship, wellbeing or any other outcome. Nothing in this section affects the statutory rights you have as a consumer.
16. Limitations and exclusions of liability
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under Polish or EU law or the mandatory consumer law of the place where you live.
Subject to the paragraph above, we will not be liable, whether in contract, tort (including negligence) or otherwise, for: any loss of revenue, profits, data or anticipated savings; any loss of goodwill or reputation; any decision you make based on content produced by the Services; anything your partner does with content you have shared with them; or any indirect or consequential loss. Subject to the same, our total liability to you for all claims arising under or in connection with these Terms is limited to the total amount you paid us for the Services in the 12 months immediately before the event giving rise to the liability.
17. Governing law and disputes
These Terms, and the relationship between you and 4couple, are governed by the laws of Poland. If you are a consumer, you also keep the protection of any mandatory rules of the country or state where you live, and you may bring proceedings in the courts there. We would always prefer to resolve any problem with you directly, so please contact us first. EU consumers can also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
18. General
We will not be liable for any failure or delay in performing our obligations that is caused by an event beyond our reasonable control. In that case our obligations will be suspended for the duration of the event, and we will use reasonable efforts to find a solution.
We may transfer our rights and obligations under these Terms to another organisation, which will not affect your rights. You may only transfer your rights or obligations if we agree in writing. If we do not enforce a right under these Terms, that is not a waiver of it. If any provision is found to be invalid, the remaining provisions will stay in full effect. These Terms are the entire agreement between you and 4couple regarding the Services and replace any previous version.
